Terms of Service
1. Scope and Subject Matter
These Terms of Service govern the use of the nextunyte web platform (hereinafter "Platform" or "we") by registered users. The Platform offers free content (e.g., prompt templates) as well as access to paid digital courses and playbooks regarding AI-generated imagery.
2. Contracting Party and Payment Processing (Merchant of Record)
For the purchase of paid courses and content on our Platform, we use the payment processor Paddle.com as our "Merchant of Record" (MoR). When you purchase a paid course, you enter into the legal sales contract directly with Paddle. The terms and conditions of Paddle apply to the checkout process and payment processing. These Terms of Service supplementarily govern the usage of our Platform and our course materials.
3. Registration and Account Security
The use of certain features (such as downloading prompts or accessing courses) requires registration. The user is obligated to keep their access credentials confidential. Account sharing (sharing an account with third parties) is strictly prohibited. In the event of a violation, we reserve the right to permanently suspend the account without any right to a refund.
4. Usage Rights and Intellectual Property (Copyright)
All content provided on the Platform, in particular videos, text documents, the "Master Playbook," and the "Prompt Vault," is protected by copyright. The user is granted a simple, non-transferable, non-exclusive, perpetual right to use the course contents for their own (including commercial) purposes. It is expressly prohibited to copy, resell, publish, distribute, or make available to third parties the course materials, PDF documents, videos, or structured prompt collections, in whole or in part.
5. Disclaimer for Third-Party Tools
Our course teaches workflows that rely on third-party software (in particular OpenAI / ChatGPT and Higgsfield). We have no control over the availability, pricing, terms of service, or algorithms of these third-party providers. We accept no liability if workflows no longer function as described due to future updates or changes made by these tools. The use of these third-party applications is at the user's own risk.
6. Warranty and Guarantee of Success
We provide our knowledge and workflows to the best of our ability. However, we do not guarantee any specific economic success, increase in social media reach, or financial profit achieved through the use of our strategies or generated images.
7. Changes to the Platform and Terms
We reserve the right to change, update, or adapt the Platform, the free content, and parts of the course (e.g., to reflect updates regarding new AI models) at any time. We also reserve the right to amend these Terms of Service with future effect if necessitated by legal or technical developments.
8. Final Provisions
The laws of the Federal Republic of Germany shall apply. Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
